Faith Temple v. Town of Brighton

A federal district court in New York recently ruled that RLUIPA does not apply to eminent domain actions. The court dismissed the RLUIPA claims of Faith Temple, a growing congregation which bought land to build new, larger facilities. The Town of Brighton wished to use the land for a park and began eminent domain proceedings. The court analyzed RLUIPA and concluded it did not apply to eminent domain procedures. This places the Western District of New York at odds with the Central District of California, which has ruled that RLUIPA does apply to eminent domain proceedings.
